What is included in final pay?
Final pay (often called back pay) covers everything the employer still owes when employment ends: unpaid salary for days worked, the prorated 13th month pay, cash conversion of unused service incentive leave (and other leave, if company policy makes it convertible), separation pay when the law or a contract requires it, tax refunds, and other benefits due. Lawful deductions such as outstanding loans are subtracted.
How soon must final pay be released?
Within 30 days from the date of separation, under DOLE Labor Advisory No. 06-2020, unless a company policy, contract, or collective bargaining agreement provides a shorter period.
Is unused leave converted to cash?
The 5-day service incentive leave under Article 95 of the Labor Code is convertible to cash if unused. Other vacation or sick leave is convertible only if the company policy, contract, or CBA says so.
Can the employer withhold final pay until clearance?
Employers may require a reasonable clearance process, but it should not delay release beyond the 30-day period. Deductions must be lawful and authorized, such as documented loans or amounts the employee agreed to in writing.
